EB-2 India is still listed as “Unavailable” in the August 2026 Visa Bulletin Final Action Dates chart. For applicants checking the August 2026 USCIS bulletin for EB-2 India, that is the controlling fact: no EB-2 India immigrant visa numbers are available for final action in August, and USCIS says employment-based adjustment applicants must use the Final Action Dates chart for August filings.[1][2]
The Dates for Filing chart remains at January 15, 2015, but that date does not open a filing window in August. It matters only as a contrast, because USCIS has not authorized use of the Dates for Filing chart for employment-based adjustment filings this month.[1][2]
The practical consequence is direct. Pending EB-2 India I-485 applications cannot be approved while the category is unavailable. New EB-2 India I-485 applications cannot be filed by relying on the January 15, 2015 Dates for Filing entry. Approved or pending I-140 petitions still matter for the employment-based process, but they do not by themselves create adjustment filing eligibility or permit green card issuance when no visa number is available.
What “Unavailable” Does, and Does Not, Do
“Unavailable” is stronger than an unfavorable cutoff date. A cutoff date tells applicants which priority dates are earlier than the line for that month. “Unavailable” means the category has no numbers available for issuance in that chargeability area for that preference category. For EB-2 India in August 2026, the line is not merely far back; it is closed for final action.[1]
For a pending I-485, this does not mean USCIS has denied the case. It means USCIS cannot approve the adjustment application while the visa category is unavailable. A case may remain pending, may continue to sit in inventory, and may still require responses to any valid USCIS requests. But final approval depends on visa availability, and in August 2026 EB-2 India has none available for final action.[1][2]
For someone who has not yet filed Form I-485, the answer is less comfortable. The January 15, 2015 Dates for Filing entry cannot be used for August 2026 employment-based adjustment filings because USCIS has directed applicants to use the Final Action Dates chart. Since EB-2 India is unavailable on that chart, there is no EB-2 India adjustment filing window in August.[1][2]
For an H-1B worker with an approved EB-2 I-140, the I-140 remains an important petition approval, but it is not the same thing as a current priority date. It can support later steps when the chart permits them; it cannot turn an unavailable final action category into an approvable green card case.

How FY 2026 Reached Exhaustion
The August result is easier to understand if it is read as the end of the fiscal-year allocation sequence, not as a normal one-month retrogression. EB-2 India began FY 2026 in October 2025 with a Final Action Date of April 1, 2013.[3]
In April 2026, EB-2 India advanced to July 15, 2014, a movement of more than ten months. WR Immigration reported Charlie Oppenheim’s description of that movement as “completely artificial,” tied to a 75-country policy change. That comment is useful context, but it is secondhand reporting, not a State Department rule or a primary transcript.[4]
By June 2026, the category had moved backward to September 1, 2013, a retrogression of more than ten months from the April date.[5][6] In July 2026, EB-2 India became unavailable after India’s pro-rated EB-2 annual limit was exhausted.[3] August is the second consecutive month with the same unavailable status.[1]
This Is an India EB-2 Problem, Not a Worldwide EB-2 Shutdown
The August 2026 bulletin treatment is not uniform across EB-2. EB-2 China remains at September 1, 2021, and EB-2 for all other countries remains current, according to Fragomen’s August bulletin analysis.[1] That comparison is not meant to soften the effect for Indian applicants. It shows the issue is tied to the India EB-2 allocation and demand pattern, not to a total closure of the EB-2 preference category worldwide.
The scale behind that demand is not new. The broader EB-2 India backlog has been reported at approximately 426,000 principal applicants and more than 862,000 people when dependents are included, based on June 2023 Cato Institute figures cited by Shusterman.[7] Those numbers may have changed since then, but they give useful proportion to the monthly bulletin swings. The August 2026 result is occurring against a backlog large enough that brief forward movement can quickly be overtaken by demand.
There is also a separate warning for EB-1 India. Fragomen reported that the State Department warned EB-1 India could become unavailable in the coming weeks because of high demand.[1] That warning may matter for applicants comparing EB-1 and EB-2 strategies, but it should not be read as changing the August EB-2 India answer.
When Relief Can Realistically Arrive
No forward movement is expected before FY 2027 visa numbers become available on October 1, 2026.[1][3] That does not mean the October 2026 Visa Bulletin has a confirmed EB-2 India cutoff date. It means the fiscal year reset is the next point at which new annual numbers can support renewed availability.
Prediction sites and law-firm outlooks can help applicants orient themselves, but they are not agency instructions. The operative filing answer for any month still comes from two places: the Department of State Visa Bulletin chart itself and the USCIS page telling adjustment applicants which chart they may use.
