Indoor farming faces food safety rules written for fields

Indoor hydroponic lettuce operations are not covered by the FSMA Produce Safety Rule in the same way as field farms, creating a regulatory vacuum filled unevenly by private certifications. This analysis compares the legal exposure and enforcement landscape for both sectors.

A field rule applied to a facility

The FSMA Produce Safety Rule was built around the logic of open-field production: soil, weather, animal intrusion, agricultural water, and other familiar field risks. That matters because indoor hydroponic lettuce is not a field with walls. In a recirculating system, the legal question is not whether the old controls sound reasonable, but whether they describe the hazard path that actually moves through water, surfaces, and shared equipment. The gap is not just conceptual. Lewis Ivey et al. found only 32 intervention studies across 131 hydroponic food safety papers, none of them on commercial-scale operations, and half of the intervention articles did not even specify the hydroponic system type. The FAO's 2025 review lands in the same place: there is still no commercial-scale validation that would let anyone speak confidently about a settled indoor standard of care. [1][2]

The outbreak made the mismatch concrete

The BrightFarms Salmonella Typhimurium outbreak in 2021 gave the regulatory problem a record, not just an argument. FDA's investigation tied the outbreak to 31 illnesses and 4 hospitalizations across four states and treated it as the first major outbreak traced to a CEA indoor hydroponic facility. [3]

What mattered legally was not only that contamination occurred, but where FDA said the contamination pathways came from: a stormwater drainage pond next to the facility, growth media storage practices, and water management gaps. Those are not the usual field-farm assumptions the Produce Safety Rule was written to manage, which is why later trade coverage said FDA responded with CEA-specific guidance. [3][4]

Private standards are filling the vacuum

The CEA Food Safety Coalition launched the first food safety certification aimed specifically at indoor-grown leafy greens in 2022, after forming in 2019 in response to the 2018 romaine recalls. Its four modules — hazard analysis, water, site control, and pesticide or herbicide use — are a direct attempt to name the risks that the federal rule leaves awkwardly underdescribed for indoor systems. That kind of certification helps, but it does not solve the legal problem by itself. It works only where buyers demand it, auditors repeat it, and operators can afford to adopt it. The contrast with LGMA is sharper: LGMA covers roughly 90% to 94% of U.S. leafy green production through mandatory third-party audits, and it continues to function outside the federal enforcement pause. The pause widened the split, but only for now

A 2026 trade press report on the Consolidated Appropriations Act, 2026 said Congress barred FDA enforcement of the Food Traceability Rule, the Produce Safety Rule, and the Pre-Harvest Agricultural Water Rule. Read narrowly, that is a pause, not a repeal: the enforcement window closes when the legislative restriction lifts. [7]

That temporary pause widens an existing gap instead of closing it. Field growers covered by LGMA still face mandatory audits, while indoor hydroponic operators remain dependent on certifications and buyer protocols that vary by program and by customer. [6][7]
